New GM not responsible for old GM

Post by 10vibe »

GM says new GM is not responsible for old GM warranties and lawsuits.http://www.thetruthaboutcars.c...ility/http://www.detnews.com/article...Bankrhttp://www.chicagotribune.com/...storyI hope this is not signs to come. I think the wording here is wrong:…"..... and now, on top of it all, its arguing that the “new” post-bailout GM “only agreed to warranty obligations of cars assembled before 2009.”...Probably should be, ..."cars assembled AFTER 2009."...Edit 8-21-2011: The GM lawyer's wording is technically right in the fact that they only want to provide specific expressed warranty obligations of "cars assembled before 2009", but want to make a distinction that old GM's design mistakes are not covered, just possibly manufacturing mistakes. ..."GM's legal response says because the issue is not that the spindal rods were manufactured incorrectly, butthat the design was the problem, precludes the lawsuit from going forward."...http://detnews.com/article/201...70421GM did not assume responsibility for Old GM's design choices, conduct, or alleged breaches of liability under the warranty...."There are no specific factual allegations that New GM -- as opposed to Old GM -- did anything at all inrelation to her vehicle," Jeffers wrote. "Plaintiff here is trying to saddle new GM with the alleged liability and conduct of old GM."...GM says bankruptcy excuses it from repairs on 400K cars - Chicago Tribune.Just one more reason to shop around instead of being brand loyal. GM's actions gives the impression of not being loyal or honorable.EDIT: fixed broken links, hopefully.

Maybe you should send a letter to President Obama about this.

One thing I have noticed with GM the last few years, getting items warrantied has become more difficult.

I hope getting warranty work or additional TSB's done does not get any more complicated depending on whatever the rulings will be.From a first glance, it might look like this case is just about 2008 Impalas. From a law point of view, this is setting precedents. I do not know if this case has any real merit. It is the argument from GM that disturbs me.I find it interesting that they are finding distinctions between design and manufacture for laying claim on what “New GM” should be held responsible for. I would think if something is defective, it would not matter whether it is a design flaw or manufacturing mistake. Fix it! I can imagine having a plagued Impala that is going through rear tires every 6-20 thousand miles and the service manager is saying, “ it is just the way these cars are and nothing we can do for it.” ... “Maybe it is something you are doing wrong.” ... “Keep the tires properly inflated and take corners slower.” ...”we can sign you up to our ultra tire service program for which we will balance and rotate your tires every 3000 miles for an outstandingly great value of $200/year plus shop supplies, waste and disposal fees per visit and that includes our exclusive 70 billion point inspection and free air. Road hazard and tire repair extra “... “We can have you talk to our sales person who would gladly offer you a real lowball price for your used car since it is defective, but not of our fault, and sell you a new one at MSRP.”...”oh by the way we found some non warranty items that need to be fixed immediately while doing our 70 billion point inspection and all we need is your credit card, unborn child, and to sign us as your beneficiaries to your life insurance policy...and we need to have those signatures before we show you the final bill”........ From a marketing stand point this does not seem bright either. Luckily for GM it is not a big news story yet. It is also interesting that they are making a delineation point of June 2009 when GM became the “New GM.” If the car was manufactured before June 2oo9, but purchased after June is it a new or old GM, no matter what the model year?

...then, maybe *WE* shouldn't trust the "new" GM to standby / make-good any "new" warrantee's that they wave around each car?
...and the Devil said: "...yes, but it's a DRY heat!"

I can see a case if the vehicle in question was a Pontiac or Saturn because those brands were killed off. But not on something from Chevy and especially something that is still being made. The 9th Gen Impala was first made in 2006 and is expected to be made until 2013 or so. That means the "new" GM is still making a flawed design from the "old" GM. This is one of the reasons I bought the Vibe because it is a Toyota and repairs are simple and reliability is great. My Aura even though it is well maintained is falling apart with less then 35,000 miles on it. I think my next car that replaces the Aura will be a Ford Fusion or a Toyota rpoduct(I already have one )
