Let me make this short and to the point. I was dropping off my fiances daughter to school and I slow down for traffic & WHAM! The result is a broken tailight, bumper, damage to corner of hatch & some 1/4 panel damage. Young girl, no older than 19. Cop arrive and writes out a report & says things should be fine and that they have insurance. I have all the info I need to make a claim ( I have Geico & so do they) The father of the young girl who hit me shows up & wants to settle this outside of the insurance company. I agree to it. Later I call him to tell him Im going to go through Geico & make a claim to cover myself cause I dont want to get burned. He then tells me the van his daughter was driving had no insurance, thats why he wanted to settle it on the side. I tell him im going to go through Geico & file the claim.I call my insurance company & they confirm that the van was not on the policy so I have to file a claim under my insurance, pay my $500 deductible to get my car repaired. I ask the agent if they are going try to recoup my deductible & they said no. Unbeleiveable.So basically I have to pay $500 to repair my own vehicle in an accident that was NOT my fault because the other party had no insurance. I spoke to my lawyer I she says I can go after the party reponsible for hitting me for my deductible, which makes sense. Any advice???This amazing.....3 years ago ( to this month ) I got rearended & my car was totalled. Here in South Florida drivers LOVE to tailgate!!!! Just hit 98K drained, filled the radiator & block. Vibe is in GREAT shape. Grrrrr....

That sux man.Years ago I got hit by an uninsured driver, had to pay the deductable. My insurance company (Allstate) went after them, kept after them, and over a year later I got a check for the deductable. I didn't have to do a thing. Might want to consider changing insurance companies?
Makes no sense. If the cost of repair is $2,500, and Geico is paying $2,000 after your deductible, then Geico will be certainly be going after them for their $2,000. Just as easy to go after them for the $2,500.However, if the father was willing to cover it outside of insurance, then why would he not also cover your $500?I think my auto insurance includes (at a very minimal extra premium) coverage for the $500 deductible where an uninsured is at fault.

I'm sorry to hear that. I'm glad it's not totalled and you're OK. It's not just in Florida, believe me. I don't know how many times I've looked up at the rear view mirror expecting to get hit, because some dummy is coming up fast behind me while I'm stopped at a light (some with their hands glued to phones, some looking to the side and talking to the front passenger) with my little one in the back. An uninsured dumbarse caused my brother's car to be a total loss. Because of it he has to testify in court and my mom missed the birth of her only grandchild.
He offered to settle up, tell him you need the deductible or small claims court.I'd look at changing ins company. I got rearended, have AAA insurance. They went after the guy to collect, even after it turned out his insurance had lapsed, and I did not have to pay the deductible.
