Minor mishap ..... please need input!

Today while entering the underground garage of my apartment ... The garage door hit the roof rack and damaged it ..... before you jump into conclusions .... here is the full story.Another car entered the garage 15 seconds before me so when I reached the garage door, it had started to close. I pressed my garage opener and the garage door went up again. While I was halfway thru it the door hit my roof, scrapped a bit of paint due to sand particles in it and finally broke the roof rack. Pictures: http://picasaweb.google.com/ra...p3mkg#Apparently the person who had entered before me had a faulty opener and hence it was stuck and kept on partially opening/closing the door. She came and apologized to me and will complain to the apartment office. I plan to go there too tomorrow evening.Questions:1) who is at fault? 2) Should I report this to insurance?3) How hard/expensive is it to fix the broken piece out of pocket?Any suggestions appreciated.Thanks!!!

It's not your fault that the remote/door was defective, and you didn't know, so why should you have to pay for it out of your own pocket? Especially if paint repair is involved Hope this is all settled quickly. (mine's going on 4 months now.) I hope for your sake you don't have to deal with a real dungbeetle like I'm dealing with.

Well this could get hairy. Once the door hit your roof did it bounce back up? I thought garage doors HAD to for safety reasons, ie. a small child stuck under and getting crushed. I would talk to the building/apartment owner and get them to pay, You'll then prolly have to have a estimate etc. just try as hard as you can to make the apartment pay. The plastic piece will run 30-50 dollars and is the paint even scratched or is that just a scuff that could be rubbed/buffed out?

I would have thought that Walmart foam ball would have warded off all evil garage door spirits!! That's it.....I'm returning mine right now.

Thanks for all your suggestions ..... I'll visit the apartment office tonight and let you know what they have to say ....This just sucks!!!Thanks for the input!!!!!!!
