I read this over on MO.The only thing that would have bugged me was that back gate.If you don't get along with your neighbor,F him up.Call the Township,because he did that because he's an a-hole.

Get something out of it man... be nice, you got anything else that needs a fence? You got some other issues that you need fixed? My brother had something similar happen, but it was his builder, they put the fence to close to something.... Instead of being a jerk about it, my brother had him build a deck on the back of his house around hid pool... It wasn't huge, but it saved both of them some headache.... I donno about your neighbor but it could go a long way to you guys gettin along... I don't know if you two have a civil relationship or if you're always at odds... so i'm just saying... Sucks man, but don't let it be the end of the world...
yeah man that's not cool... nobody knows what your neighbor instructed the workers to do besides those 2 parties. so yeah he coulda said "get it right up on his fence, and don't worry bout anything", or he coulda just said "i want a driveway here", paid his money and didn't care what happened as long as he got what he wanted.i know what it's like to have problem neighbors. it seems like they'll do lil things to (removed) you off just to see how much crap they can get away with before you do somethin. then they call the authorities to make you look like the bad guy. it sucks, but it's great when it backfires on em you talked to your neighbor right away, that was the best thing to do, and he said he'd have the problem taken care of. so just give it a few days, then ask him what the situation is. if he gives you attitude, contact the people you mentioned, wait til everything's taken care of, and then do this to him: . good luck keith.about sunny's comment... i'd go nuts if i had to drive through a half mile of dirt every time i left the house. all that dust would kill me(and quadruple my car wash expenses)

I would call code enforcement and have them come by, also have the name of the company ready.if they did break code they will get fined until it's fixed all so if they got is on the fence it's most likely stained and would all need to be replaced

If he didn't I printed out the code page refering to the the problem, and I will hand it to him and tell him that the code office will be stopping by.

whatever company did the paving did a horrible job to beign with...even if I was your neighbor I wouldn't be happy paying for that "quality" of work (sarcasim)... yuck.p.s.- Can't wait to see you on Judge Judy.

Certainly a show down is in the making. The reason why there is a gate there to alow access for the meter readers and for me access to the side of the house to mow the lawn.I was able to re-aline the fence to alow it to open and close now. The problem is still with the melting of the fence when they paved over the property line and paved on to the fence.The post in question is filled to the top with concrete. I don't know what more I could have done to prevent them hitting the post with a steam roller short of taking off the day if i knew my snake of a neighbor was getting it paved.Again, they could have prevented this if a edging of some sort was used. a simple 2x12 burried and supported on the one side would have prevented all of this. i did... and if you have ever watched sanford an son... he would be sanford... always collecting junk and thinks the world owes him because of his "color" and his disability. I would be happy with a fixed fence. Should cost about 200bucks estimated of course.Just look in the at the spot between the house and the garage... hes got an old washing machine there... it's been there for MONTHS.

So long as you can prove the fence is within your property limits, it'll need to be repaired or replaced.Depending on the zoning laws within your area, the contractor may be responsible for it.If not, your neighbor's property insurance will cover it.Either way, you'll likely be able to get the entire section replaced. It will probably be up to you to decide whether or not you want to force him to move the edge of the driveway, though.
Ok, just a slight update. Contacted the zoning office, talked to a very nice guy. He said he went and viewed the problem first hand. Seen exactly what I was talking about and backed me up 100%. They are going to make the neighbor remove the pavement.The zoning officer read the owner the riot act, about damaging the fence and how he and the paving company would lose a civil action if one would be filed. He suggested that the paving company and him split the cost of repairing the fence and be done with it.The zoning officer also called and read the riot act to the paving company. I don't know if they will be fined because they did apply for the permit but it was never approved. So they paved with out a permit. They have done other jobs in the township and they know that they can't come with in five feet of a property line. They are in the wrong as well.I am now just waiting to see if the neighbor trys to file a varience to keep his driveway. The zoining officer told me that if he did... it would never be alowed...

I understand that it's against the zoning laws, but no thoughts as to having him simply sawcut back about 2.5 ft and taking out the 2.5 ft of asphalt? I only offer this as a compromise as it might help make amends with the neighbor. Nobody wants to live next to people who they really can't get along with and while I can see you would be upset as he is out of compliance, and why should you have to suffer because he broke the law, but often times it is at a cost of our pride that we can salvage relationships with our neighbors...I am glad that they are going to be found liable and it sounds like you'll get your fence fixed. It was a sloppy job no doubt, I am just trying to offer up ways to mend fences. My neighbor has trespassed into my backyard to "shutup" my dogs from barking - at 10:00am in the morning. I also got a letter from him threatening legal action for violating the city sound ordinance. Well, the ordinance is only in effect from 9:00pm to 9:00am, and I'm at work at 7:30am, so there is little I can do to keep the dogs from barking at 10:00am. However, he has since taken a much more calm approach since I ensured him that I would take every chance I could to quiet the dogs. Things have gotten better between us and its because we both put in the effort to compromise and understand each other...he's not right, I'm not right, he's not wrong, I'm not wrong, we just both want to live peacefully.

They are just waiting to see if the neighbor files for a varience, and the other thing is as TJinPgh said about his homeowners insurance covering it. Thats not an option because years ago my neighbor informed me because the house is paided for he didn't carry homeowners insurance. I don't know if that has changed or not. Also, I highly doubt that the insurance company will cover negligence and stupity.

Insurance would typically cover this type of situation. Odds are it might take awhile for the pavers insurance to admit fault. I believe that here in AZ property insurance is still required for liability issues (say for example, some robber slips on the newly waxed granite tile and concusses himself, he can sue for injuries - dumb I know). Same thing as driving, just because its paid for doesn't remove the liability requirement.I only offered it as a suggestion because sometimes, even the zoning office prefers things to be taken care of as they are often overworked too (here in Phx metro at least).EDIT: I would also fight to make sure they don't just trench it in the 5-ft easement to meet the drainage requirement - that will still cause way too many problems...
