Whats scary? That its being banned? Or that it was allowed in the first place? Personally I think the latter. Wow thats amazing!

That's, um, interesting! I was under the assumption that all localities had some sort of open container law... I know we've had one here for a pretty long time - way before everything had cup holders to put the open cans or bottles of booze in. The thought of someone saying "hey man, I made it from here to Butte last night in only 6 beers!" is rather disturbing, I think...

What is really scary is that Montana has the "no speed limit" on the highways thing I think. People in Montana are probably thinking they are getting shafted. Just about every other state in the union has to do the .08 blood alcohol content to get their federal money. Nothing scarier than a hillbilly in a rusted out '78 Chevy truck doing 95 with a 6 pack of Natural Light in his system. (involuntarily shudders)

it would take more then a 6 pack for the average "hillbilly" to be affected try atleast a case (for the non drinkers thats 24)

There was a time in the mid 90's where the limit was abolished, but that only lasted a year or so. If you are clearly impaired, it's no different than any other state. The lack of an open container law just means that if you have a bottle open in the vehicle you can't be cited for it if you're not above the legal BAC. That is not to say I support the lack of an open container law. I think it's ridiculous to say you can pull over a drunk driver then basically facilitate drinking and driving. I guess maybe it's their way of making sure they always have a steady supply of drunk drivers to pull over.

Don't other things that come in bottles or cans also fall under the open container laws, alcohol or not? I seem to remember someone telling me that in high school. Something akin to saying it has to have a lid and a straw so you can drink it without obscuring your vision...but that could have just been something that started as an, "I wonder if this is true" and turned into a rumor.

A long time ago I heard that the temperance folks were resigned to the fact that they can't stop alcohol consumption, so they decided to just make it as difficult as possible. If you are cold stone sober and just happen to have an open bottle of any alcoholic beverage in your car (like bringing it home from a party - even the next morning) you are guilty. I suspect that even if it is in your locked trunk you are dead meat. I can see banning drinking while driving, but these open container laws are a bit beyond the necessary. If I am in my front yard enjoying a brew and carry it while walking across the street to talk to my neighbior, I am in violation of the Ohio open container law. Saddam had his way of torturing his subjects, and our governments have their way of doing the same.

I heard the same... But I'm sure open container laws just apply to alcoholic beverages... At least I hope so, or else, send me to jail!
