Got rear ended

I was at Mt. Clemons for the weekly Wednesday evening car show. I was parked at a bank and was about to leave. There were a million cars everywhere, so it was difficult to get out, finally after a white S10 extreme passed, it was clear and I could back out and leave, well as soon as I backed out and shifted to drive the dumb@$$ in the extreme slammed it into reverse and smashed into the back of me. It put a nice sized dent across the left reverse light and punctured a hole in the plstic about he size of a dime. Michigan is a no-fault state so his insurance wont cover it unless my car was parked, and I cannot tell my insurance company about it or they will triple my rates...so I have to pay for a whole new bumper with my own money....it's taken me like a month to save just $100!!!!

That's harsh dude. Yeah, I've been hit 3 times in 1 year. Not even drivin the damn car. Seriously. First time, at a patty and some off duty cop said that my car was hit. Second time, at skool, my buddy walked by my car and saw that it was hit and he called. Third time, I was in the East Coast for like a week or so, got back yesterday and noticed these scratches on my bumper. Dunno what I'm gonna do bout this one. Overall, my car's total damage has been $8000. Not including what happened on the east coast the past week. Don't even when it happened either. That's what really sucks. But I hope all goes well for your car dude. Hey, do this, tell ur insurance company that it was hit at ur work. And have a slip from one of your buddies sayin that he saw ur car. That's what I did for mine. My dad claimed it in his garage. So, yeah. Keep us all posted on what happens. Once again. Sorry to hear that dude.Inder Singh

Ohhhhh . . . I don't give a damn for the whole state of Michigan, 'cause I'm from O-HI-O. But what happens if a Non-Mich driver gets hit while he is in Michigan? If non-MI driver is at fault, does he escape liability? If non-Mich driver is not at fault, doe she have to rely on his own ins coverage?

That's about the stupidest law I've ever heard of. "Hey, lets make the insurance companies richer and let the stupid drivers get away with everything!" Is there any other states that have this, or is MI the only one?

I know Nebraska is also a no fault state, but am unsure of exact laws.

That blows chunks dude. Hope you get compensated for that. From the way it sounds it was mostly the other guys fault.Me being from Iowa (one of the smarter states even)and I am confused by the "no fault" law. Maybe I misread the previous post explaining it, but it sounds completely retarded. What average person would gain anything from a law like that.

Can you still sue the other guy for the "back injury" that you suffered in the accident?

Sorry to hear about this Merbow. Maybe if you meet the guy wearing a neck brace he'd be willing to settle out of court and fix your car for you? I really hope he pays for something

Maybe he'll sue you, claiming you had your illegal underbody lights on which caused him to misjudge the distance, or maybe blinded him or sent him into a seizure, or that he figured since it was illegal to run with them on, you must have not been moving.j/k sucks, cuz we know how much you care about the car. Good luck!

If he tries to go for the $500, he will have to go through his insurance and his rates will go up. He does not want that so he is on his own. I hate No Fault as well, especially coming from Ohio to here 7 yrs ago but it was told to me No Fault protects the insurance companies and customers in a way, from all the law suits people sue over. Which results in insurance companies raising their rates to pay for all the law suits. The Chevy guys insurance would have to pay for all if it happened in the parking lot and the Vibe was just parked sitting there.

Right but you were not at fault. Either was he but it sounds like the cops were not called hence the cops did not state who was at fault in the police report.

I believe the police need to be called right when the accident happend to state who was at fault. Yes a police report can be filed at any time but the police cannot state who was at fault since the accident happend days ago. For now the report would just be hearsy but you and I know who hit who first.

Well, I'm not going to be able to file a report, my mom used to work for AAA and she said with the kind of coverage we have, they would end up boosting our rates to about $4000 a year from the current $2500, that is of course if they didn't reject us. I don't know if she's feeding me bullsh*t to shut me up or not because to me it seems rediculous to pay that much for insurance and for it to be completely useless...why have insurance if you cannot even get anything fixed! F*ck insurance companies, that's all I gotta say. Thanks for all the help and info. everyone, so atleast next time something happens I know what to do.

one thing i learned from my first accident in my tundra is ALWAYS call the cops! you need them to say who's fault it was or it's a mess.

my friend Dave who got his sunfire clipped in the front end by a lane merging focus did not recieve a lot of damage, they pulled over and got eachother's insurance and other info and since we were all in a hurry (dave and a few of us were driving to a car meet) we all left.We get home later to find out the girl called the cops and claimed a hit and run on us... which did not work because Dave had 8 of us as witnesses... but because everyone left the scene of the accident, no one's insurance would cover any repairs.Lesson learned? Call the cops.

Wait until you own a house.... Same thing, do you call the insurance to make a claim or fix it on your own. I say Insurance, the necessary evil!
