Car tried to peel out while I was stopped

Hello! The check engine light came on and I turned around and drove home. I pulled into the parking garage and stopped as one of my neighbors walked up to my car to talk to me. I was stopped for about 20 seconds when the car tried to peel out. I shoved it from Drive to Neutral right away and the rpm's dropped to normal idle.
The next day I took it to the dealer. They are saying it's throwing codes P2121 and P2138 for an accelerator position sensor. The dealer is trying to argue that it isn't covered under the epa 8/80k warranty, but I don't think they've read that in a while since the neanderthal looking tech said "that only covers the catalytic converter". I have a call into GM warranty to see if they are going to fix an obvious safety issue.
On another note, doesn't the accelerator assembly bolt on with two bolts and a plug? Seems like the $300 labor quote is a little steep for that.
Anyone experience this issue? This sounds like the Toyota debacle and is completely unrelated to the size of the gas pedal or to floor mats. This is on a 2008 vibe w/60k.

Good luck in that regard. As far as GM is concerned, Pontiac (and the Vibe) are the past. They are now focusing on the makes they have left, so it's not surprising the lackadaisical attitude of the dealer you went to (Have you tried a Toyota dealer by any chance?)

The $300 quote could be for diagnostic and tests, since they would probably try to duplicate the issue.

Have you also checked to see if your 2008 is part of the PCM recall?

8/80 warranty is for emission related issues. the accelerator pedal is not related to emissions.

your argument is invalid.

8/80K IS FOR all systems within the power train drive control...aka - anything connected to the ECM which effects the driveability of the car....that should include the accel sensor/pedal thingy. Read your warranty in the back of the owners manual.

Did you get the PCM replaced? Your year was part of the recall and the issues you described sounds like you have that problem.

the accelerator pedal is not listed in the 'parts covered' section in the warranty manual. what the Neanderthal mechanic told you is still correct, the pedal is not covered.

your argument will be validated IF the the issue is within the throttle body.

This is VERY much an issue with the early DBW cars Toyota made and they blamed it on the bad "solder joints" in the ECM

The OP has a 2008. Shouldn't the issue have been fixed by then?

I believe 2008 was part of the recall
