Ate 1-2 bags a day! (removed)! Now it is the grocers fault? Eating popcorn in general 1-2 bags a day is probably not good for someones body due to lack of nutrients! Microwave or not! That alone should had made this guy stop doing it! He probably has or will have some other effects from this in the next years too. Man Sues Grocery Over 'Popcorn Lung'Denver Man Ate Two Bags A DayPOSTED: 7:17 am PST January 16, 2008DENVER -- A suburban Denver man is suing a grocery store chain over a lung illness he says he got from his microwave popcorn habit.Wayne Watson (self proclaimed IDIOT!) is believed to be the only consumer to develop "popcorn lung" from regular servings of microwave popcorn. The condition is said to be caused by the artificial butter flavoring chemical diacetyl that previously sickened only popcorn factory workers.Watson's attorney, Kenneth McClain, said the lawsuit filed in U.S. District Court names the Kroger Company and two of its divisions. A Kroger spokeswoman said the company does not comment on lawsuits.Hundreds of workers have said they have severe lung disease or other respiratory illnesses from inhaling the chemical vapors while mixing large vats of flavors. The lawsuit, which seeks unspecified damages, states that the companies failed to warn consumers about inhaling the aroma. In December, the makers of popcorn announced that they would no longer use diacetyl. http://www.kptv.com/health/15061290/detail.html

He may be stupid and fat or otherwise, but that is not the point here.He purchased a product that, through repetitive use, ended up causing severe medical complications. I don't believe he is the first, nor will he be the last person who enjoys the smell of fresh popped popcorn.I think those who smoke and sue are more stupid than this. This guy is inhaling an aromatic product that was specifically designed to smell good. Turns out, some of what he was smelling was poisoning him. If the popcorn people are aware of this chemical's contribution to employee illness, yet they still employ its use, then they are indeed liable for this.In the end should the guy get $10 million? NO way...but should the popcorn peeps cover his medical bills and any lost wages and earnings only making him whole? Yes.

No that is true and I hear you... The chem is not being used anymore as we are supposed to believe now too. And he needs to go after the popcorn comp NOT the grocer. He should have sense enough to understand that but not sure if he is the sharpest knife in the drawer. Plus Popcorn Lung Disease has been around or talked about for years. After reading the symptoms find it hard to believe this guy was not showing a health sign something was not right. Maybe even figured, I should go to the doc and lay off eating all this corn, the corn may be causing my (insert symptom). Somehow too late though, someone figured it out as being PC lung. It just shows people anywhere cannot do things in moderation. I see people drinking 4-5 sodas a day here at work. I am not addicted to smokes so maybe it is easier said than done but I am atune to my body and needs and realize things in moderation is the mindset. Not to you engineeringtwin2 but on a side note... We know lead is bad and yet we still buy toys in China made with it. Small amounts sure but that still has not changed. Yet the popcorn manf can change their chem pretty quick! What is wrong with that! I realize the toy issue is larger than this but makes one think!I bought X-mas lights this year for my house. ALL of them except GE brand had a warning stating "may contain amounts of lead in the wires, wash hands after handling". All that said that were made in China. I love the "may contain", come on, I am not dumb, it does contain! I digress, crazy, crazy world...

Chains like Krogers, Safeway, etc. put their house brandnames on many of the products they sell and they may come from a variety of different manuacturers. The jar of peanut butter on my desk just says "Distributed by Safeway, Inc." with no indication of who actually produced it.

Just FYI, wikipedia and webmd both claim that symptoms can appear severely and suddenly.Realistically, he probably thought it was chronic bronchitis, but there is an outside chance that it was sudden onset. And I'd never heard of Popcorn Lung before...Apparently diacetyl is the chemical that actually provides artificial butter flavoring. It is produced in the fermentation process and, as a result, brewers often reheat the brew a few degrees after the fermentation is complete to allow the yeast to absorb it. Some wineries in California intentionally promote the production of diacetyl to their chardonnays to get that "butter bomb" feel.

Symptoms include:dry cough shortness of breath wheezing Have you seen the movie Super Size Me? I look at this as similar (MO of course) and the amounts of the same something someone eats on a regular basis. The guy in SSMe showed signs of just not feeling right, lethargic, besides the weight gain from the Mc D's he ate each day. I really find it hard to believe this guy felt nothing, not popcorn lung but something health related in general especially at his age and then all of a sudden bham, it hit him! For how long did he have to eat it to get this this point? I mean even his BM's, were they normal? Probably never went to the doc yearly for a check up until now too. Like a lot of older men... Cholesterol checks? My wife had a roommate in college that drank diet coke and smoked packs a day, each day. Pizza on a reg basis too. She threw up too many times a month and not from being drunk. When she did it was violent too. For months she was like this if not years! She caused damaged to her throat, had acid reflux issues and something else. My wife never did know what she did from there since my wife graduated and never kept in touch with her. Poor Tara...

I accept you aren't trying to argue. I was merely pointing out that it was stated that there have been some sudden onset issues. Also, not everyone is in tune with their body. It took me a while to figure it out. Some people just accept things are the way they are. A friend of mine has celiac's and she just thought she'd have to deal with her stomach just hurting and feeling like crap. Turns out she's allergic to gluten (you have to be careful and diligent to avoid it since it's used in everything). My fiancee has IBS and has to accept that she may just have a bad day every now and then (bad day = severe nausea and diarrhea). She can avoid somethings like chocolate, dairy, alcohol, etc, but she'll still have a bad day even when avoiding that stuff...Back on topic, I'm just asking for the extremely outside possibility that it could've been sudden onset for this guy.I did state above and I'll reaffirm it here - I very seriously doubt this was sudden onset and his ignorance in suing Kroger instead of suing ConAgra (or whoever is the parent company of the popcorn company) serves as evidence to the fact.Lots of people see these lawsuits as frivolous and most are. But the oft quoted McDonald's hot coffee incident shows people need to know the facts. At the face of it, if you order hot coffee, you should expect hot coffee and not sue when you get what you ordered. The case in point here is that scalding temperature is considered between 125F and 130F. Most hot water heaters are regulated to no hotter than 120F, meaning a HOT shower is typically no higher than 120F. The coffee served at McDonald's that subsequently burned the customer was served at 185F, which is what the National Coffee Association has set as the ideal brewing temperature. 185F is hot...I guess I like to think of the "made whole" principal and argue that pain and suffering is too arbitrary and emotion based. If someone hits my car for $2000 worth of damage, all I ask is that they pay to repair the damage and any subsequent costs (ie rental cars) I incurred as a direct result of their actions. But, I digress.... Super Size Me was a good movie. Had he not been in some average shape or rather he ramped up his consumption overtime (instead of binging over 30 days), his symptoms may not have been as pronounced or as noticed. Remember, this guy's been a "2-pack a day" guy for several years...not just the past couple months.

I think it's awfully unfair to blame the guy for the popcorn lung. No reasonable consumer should expect that a product could cause lung damage, just from normal use (i.e. popping the popcorn). Maybe what he ate was an excessive amount, but that does not excuse the industry from hiding the fact that the chemical does damage, and I do believe that they have known this for quite awhile.

Wonder what this does for the 16 yr old behind the concessions counter at a movie theater? Just curious if anyone knows if this product is used there too...THAT would be a more legitimate case than this....

I thought movie theaters had separate butter flavor dispensers that customers used. At least, that's how it works at AMC.

Not all theaters have the butter dispensers available for the public to use. Some still have the employees do it.

i think drunken is right, anyways...i love microwave popcorn because its filling and its really not that unhealthy if you look at how much you are eating...i just hate how people take the chance to sue at any random thing, i wish we could actually pass laws that protect the middlemen, it would make it at least a bit harder for people to sue...but you cant stop the idiot brigade all the time...
