Todays Checkup from car accident=no new car for me any time soon I'v been off for 2 months now after the time I had no choice to go in the day after the accident. After my arm surgery (since that part was workers comp due to being injured before my acident and being worsened in the accident) the people I work for forced me to come back to work and gave me formal writeups (x3) for not coming in the day after my surgery and I contacted them every day and the people in the office have thought my whole incident is a joking matter since day one with outrageous harrasment (which I am keeping a log of and posting to Missouri's dept. of Workers Compensation) every time I tried to call they told me nobody was in the office, but my brother works there in the warehouse I work in and he said they were there every day, finally the 4th day after my surgery I got ahold of them and told them I had my surgery, They ordered me back to work the following day telling me what your doctor wants and what your doctor gets is 2 different things. So I call my doctor and let him know and he tells them, "fine, he is to be in a CLEAN Office environment only, so they made me come in and set at my supervisors desk, who was pissed to see me back knowing I'm still not released from accident and that i had just had surgery 4 days prior. so he gives me the only thing he had which was to stamp a few tags then he said screw it take a pain pill and sleep all day. Well having to move aronud so much when ppl needed at his desk in the office i ripped a staple and was bleeding bad so had my brother drive me to my doctor and he told me to be off till tuesday of this week to let it heal up. I come back and they instantly put me back at full duty in the warehouse and having me do heavy lifting and of all weeks for my supervisor to be on vacation I was given no choice. well yesterday I was hurting BAD in my abdomen and starting peeing blood again (I'v had blood in my uruin since the accident but microscopic, now its visible) So i made an appointment and saw her an hour ago. I got a lecture for going back to work and that I'm gonna have to realise its gonna be atleast 2-3 months before I can go back to work. So now I have to have 2 more catscans and an MRI done tomarrow to see why I'm still uruinating blood. No work, no money for new car this totally sucks...guess you guys will see me trolling here more.

As much as I hate to say it, you need a lawyer, son.Take care of yourself...and I'm not just euphemizing. Keep writing in your log (and include descriptions of your physical condition every day as well).

Yea but with not bein able to work now I can't afford one. I was making good money, had a nice cushion put back, now its completely wiped out.Edit: I contacted workers compentation department and asked if I quit due to harrasment if i'm still entitled to my workers comp coverage from companies insurance and they said yes. but the only reason I haven't quit is I'd lose my insurance and no insurance would bankrupt me my dad said.

Holy crap. Good luck on getting better soon, and make getting yourself well your first priority. If you don't recover fully from all this remember- You'll have a lifetime of limited earning ability (not to mention enjoying ability) ahead of you.NOTHING is more important than your health. Period.

I don't know how the workmens comp stuff works, or what kind of insurance you have, but the way you are being treated is all wrong. Where is the driver of the truck that crossed the center line, or the electric company that owned the truck? I'd seriously talk to a lawyer, these people at work are going to kill you and you need someone who can fight on your side. I am generally against suing people, but the people are jerking you around, and you are in serious medical risk. This accident was somebody else's fault, there is no reason the other guys negligence should cause you to lose all you savings to pay medical bills.

I'm not going back until I can handle it. I'm not gonna killing myself anymore for those people, like my dad said to me just now, if they fire me not only are they adding to my harrasment suit that I filed with the state workers comp department but the insurance company is gonna be head over heels if i get fired because of off time from an accident they caused. Too much goin on at once has my nerves soo on edge its not even funny.

You don't necessarily need to HIRE a lawyer, just get one to write a letter summing up everything that has happened since your initial injury. A well worded letter that includes the threat of litigation and a jury trial will make most employers snap to. Especially if you have documentation of everything. If you Doc says you need time off, take it. There's a little thing called short term disability that's a Federal Law. You can stay out until your Doctor clears you and still get your health insurance/benefits and 75% of your pay. IM me and I'll give you my sister-in-law's email addy. This is what she specializes in at her practice.Or call Legal Aid. There are free services that can help you...

The driver, the company - where the hell are they? Inquiring minds want to know...

Yup, it's time to call a lawyer! Most Personal Injury attorneys (ESPECIALLY the ones who advertise on TV) WILL give you a free consultation (up to an hour or so), and take personal injury cases they think they can win, with no money up front. They will also take a substantial portion (40 - 50%, so I hear) of anything (damage to vehicle, medical expenses, back pay, punitive damages) they 'win' for you in court. In your case, it's sounds like it's probably worth it for you to check it out.

I'm astounded that the ambulance chasers have not been beating down his door since the day of the accident. That is just sooo not like them, especially considering an incident of this magnitude... A utility company (deep pockets!) AND the injuries involved! Whew! That's a dream come true for those guys, I just can't believe that they haven't tried to contact anyone thus far about it. And they look for this stuff, waiting for it to happen, like vultures...Anytime I've ever had the slightest fender bender, somehow my mailbox has been assaulted with advertisements from those sleazeballs. Tangerine, have you been checking your mail, or at least watching TV when Jerry Springer is on? Don't you have the old guy on the commercial that says "Tell the insurance company that you.. mean.. BUSINESS!" Surely you've heard of one of these guys! "you don't pay a dime unless we win your case! (then they take all of it but twenty bucks and make you buy lunch after the trial.) heh Good luck to you, I highly recommend as the others have, to get a lawyer already... Choose wisely however... Do something though, geez! Don't throw your life away due to someone else's negligence, you're too young for that crap.

I know what your going through. I am out on comp too. But my company won't let me work. I am still wating to get paid from workman's comp. not holding my breath though. I am thinking about getting a lawyer myself. I suggest you do to. Sue your company just for causing you to reinjure ourself and thus hindering and lengthening your recovery.

no I never posted the pics, I have a few shots on my dads digital camera but he can't find the cable to hook it to the computer after he took it to work one day so its just been setting there. The person driving the truck was given a wopping week off work without pay as punishment because his dad works there and is a big wig, they said they can't do anything about my lost wages until after my medical settlement, even if bills start to pile up. My dad has faxed them every bill I'v received and they mailed me a list of what they paid and they only paid the cheapest one of $180 for lab work. As for ambulance chasers I'v received one letter and wow he was expensive. My girlfriends dad gave me a name of a lawyer last night who does both workerscomp and auto cases and does not charge unless he wins and takes 25%. I'll have to contact him and see what I can do.

Just got back from having the catscans done, (removed) that stuff they make you drink is nasty, I got sick when I had to hold my breathe the last time through the tunnel . Doc said catscan appears normal but it can't see internal so tuesday i have to go to the hospital and have a scope run through my uruinary track.

I didn't know that this was a Ferderal law, I thought it was part of an insurance policy that a company has the option to take out. I do know that it works in conjunction with various federal policies (i.e. worker's comp), but this was news to me. Amazing what you learn here.Tangerine, you obviously deserve much better treatment than this from your emplyer, but even the best employers can suck in certain situations. I know of one employer that terminated a guy on the day he died. That way, they didn't have to pay out benefits. However, just to let you know, his family sued and won!!!I don't know what to recommend you do at this moment, but if they terminate you, OWN THEM!!!!!!Good luck and keep healing!!!
