I've been rear-ended yesterday. I was stuck in a traffic jam when the guy back my car hit me.He told me it was not his fault... His cell phone rang and he did not see me!!! What an A-Hole!!!By chance noone was hurt, neither my son and I.But the Vibe will need a (removed) lifting. The damage does not seems to be too bad, but we never know what we will find out broken under the plastic cover.

Yeah man, that's retarded. At least you saw the guy who hit your car. I got hit twice, wasn't even in the car. First time at a party and the second time at school during class.

damn, that sucks man!thurs night, i back into my cousin's car, which was on jackstands due to exhaust work. i got some scuffs on my bumper and a couple dings/scratches in the tailgate. i was reluctant to say anything, because i know the people here would accuse me of being drunk or retarded (saying i dont know how to back up)i hit it because i just plain couldn't see it, it was dark. hell, i had my head out the window while i was backing up, trying to see it.

Here you can see very well the bent in the tailgate...Also, the floor of the trunk is quite tight, I have to pull very hard to lift it, and the right locker is not working anymore....

How can it not be his fault when he allowed himself to be distracted by a cell phone which he took his eyes off the road to answer... proving the point that cell phones should not be used while driving.hope insurance can fix that all up without costing you anything.

I spoke with my insurance cie earlier today. It will not cost me anything if the version of the other driver is the same as mine and he tell them it is his fault... Let's hope this moron will tell them the truth.

He shouldn't have to admit fault...they should place fault with him as soon as he says he couldn't see you because he was on the phone. I know here, if you rear-end somebody, it's pretty much your fault no matter what. As a police officer once put it to someone who tried to fight it after hitting us, "It doesn't matter if he wants to stop in the middle of the road and get out and turn cartwheels, you have to give him room to do it." The fault is always "failure to assure clear distance."

I think I probably would have stopped the car, and got out to tell the guy to hang up his cell phone so you can use it to call the police.

This guy is a real moron!!I got a call from his insurance cie. He told them I was BACKING UP on the hightway!!!!Holly sh*t!!! He is trying to blame me for not braking and hitting me!After the impact, I did call the police to get an official report. But as no one was hurt and we were not blocking traffic and both car were able to run, they told me to feel up the form and no police is needed.Anyways, his story does not have sens (even her insurance company representative has doubt about his version), in the rapport that he signed up, it is clear that both car where going in the same direction. I also have proof where I was going (I went to a supper with some relative) and I also keep the recept of the gas station where I went after the accident.I know the 911 call I place was recorded and I specified I got rear-ended and HE hit me... Plus, if we get his cell phone records, we will see a few secs incoming call at the moment of the accident.

That seems to be the standard around here, not taking accountability for your actions. I am glad that you and your son are okay, I am sorry this jerk hurt your Vibe. This brings back to mind a conversation I was having with my mom. I was wondering the following....are sitting at a light and the light changes and you roll backwards slightly before getting everything going, and the guy behind you is up your (removed), and you hit him, who is truly liable?

If you can't see that, then your to close. At least thats how it is in Ontario and drivers can fail their driving tests if thats something they forget.

Lastest news: the Vibe going to the dealer tomorrow. They will replace the bumper and tailgate. The bad news is they will use used parts from another crashed Vibe to fix mine I spoke with my insurance cie and they can do that, as long as the used parts are not older then my Vibe.Plus I could have to pay to have my car fixe, as the f**ing a-hole who hit me did not tell the truth and tried to blame me for HIS fault....

Check with BAC (bureau assurance du canada) for an advise on this before and/or CAA. You should not pay your "$250 déductible" because you've been hit in the back by this moron. Cellular should be banned while driving. I'm sure there's a law somewhere else in US or Can against cellular/driving with $$$fine.

I've got good news from my insurace compagny. My insurance and the one of the other moron both agreed to belive my version of the story. So it will not cost me a dime for this repair.I also had the value of the damages. A total of $2336,58. Anyone here can tell me how they can get a price like that???The guy came in my driveway, took a "big" 10 mins looking at my car, taking 3-4 pics and he can tell close tot hte cents how much it will cost to repair!!! I have sone trouble to belive this.Hey, the guy at the dealer has touble giving me the exact price for an oil change, so imagine changing a bumper and tailgate.Plus, what happend if they "discover" some damage that they did not thing about them??

You can hear the Swift coming 2 blocks away...ps. nice new signature pics trdvibe

I better be careful if it is Vibe hunting season. There are dead squirrels all over the place, I don't know what is going on. I don't want dead Vibes joining them.

The Vibe is to the body shop.According to the guy at the dealer, it will probably cost more then the $2300 estimated by the insurace compagny. Now I'm driving a wonderfull Pontiac Sunfire 2001. I've been trivin this "thing" for very few miles now and my Vibe is already missing me.

i was tought many years ago in drivers ed by the State of texas that you must see the tires touch the road of the vehicle in front of you....Yes this is a big distance....there are reasons....If you need to move out of that lane in an emergency you can.......If the person does slam into your rear you are less likely to then hit the car in fron of you...Police will 99% of the time issue fault to the persons front end touches something...now if this car that rolls back rolls back an exceptional distance into someone then the police should be able to determine that, or split the blame with both parties...sorry for my rant....I'll step off the soap baox now
