yeah you need to fight the system. they come at you with an offer hoping you'll bite, you counter it with another, they respond with yet another... so on and so forth. foot it to them until they crack.

Well, I hope they fix it soon! Watch out at the settlement, Geico is cheap and may direct your body shop to replace the body panels and other parts with Chinese knock-offs! Best to stay in good communication with your body shop and stay on top of the repairs.Marc

Well, my dad got a letter in the mail today, he got it because he is the owner of the Vibe, the letter said, get this, the other driver is suing me!!! Actually my dad, it's one of those "got into a car wreck, fell, felt bad vibes from someone? Then call us, we'll sue their @$$!!!" lawyer offices where 1/3 of their 60 lawyers are board certified and one is licensed in D.C. My dad just smiled and said "let State Farm (our insurance company) handle it"

I'm sad to admit it but I handle automobile claims for a living. Your probably better off at this point letting your carrier handle it and dook it out with Geico. Especially since there is an indication that the other driver has obtained an attorney. You'll unfortunatley have to put out your deductible and possibly wait a few months before your carrier can recoup the monies from Geico. It's great that you took photos right away at the scene showing clearly where both vehicles were at the point of impact. I did want to ask at what point did you first see the other veh?Did you stop first and then were struck by the other veh? Or were you still moving at the time of impact? -It actually makes a difference.Did you have your turn signal on? Did she have hers? You clearly had the right of way but if FL is a comparative negligence state then you would end up being assessed some degree of liability. The point of impact isn't that great because she appears to have crossed your vehicle. It's also doesn't help if her version differs from yours. Did Geico talk to the witness? What does the police report say? Any tickets issued to anyone at the scene? If I were to be handling the claim I would consider liablity to be like 80-90% on the other driver being that the accident occurred in what's considered an uncontrolled intersection(meaning no stop signs, yield or traffic signals). So I think the 70% offer is a little light but typical coming from the Caveman. You didn't here this from me but working in the industry I am not a big fan of Geico's claim handling methods. I've had too many insured complain about them. Plus I've worked with a few former employees who say the turnover in their claims department is ridiculous and they micro manage their employees to death. So even if the adjuster felt liability to be to a greater degree on their insured he would still make a light offer to avoid looking like he's paying every claim that comes across his desk.Good luck. But let your carrier take care of it. That's why you pay for insurance.

(although that's not whatthe other drive will tell you)I first saw the other car out of the edge of my windshield. It happened too fast to see if they had a turn signal on or not, I saw the drivers face and applied my breaks then it was over.Geico still hadn't talked to the witness as of yet. The guy was going to call me and tell he that he did talk to him, but I've decided that I've had enough of waiting and all the Geico that I can stand. There was only a drivers exchange form with no tickets issued. So who do you work for?

So let me get this straight. You are driving on a road and he is pulling onto the road. This makes the accident his fault since he is entering your traffic way. Then this guy sues you. I hope that this does not effect you in any way in the future. The only thing that I would worry about is that the guy has already planted his seed.

To bad about your vibe, I'm sure it'll work out.I'm a little late to the party but wanted to share my story. Last June I was leaving my work parking lot for lunch when a guy, obviously not looking, backed right into my passenger side door. First thing he says to me is 'You know, any accident in a parking lot is 50-50'!!! So I call my insurance company and was told a parking lot is treated the same as a roadway - in other words - not my fault $5000 dollars later and I walk away with a whole new door, tire, and side skirt. Best part - I see him everyday at work and a year later his car is still sporting my blue paint all over his bumper.

Reminds me of when I hit that fire hydrant drifting on the ice around some S curves. Did a 180 and slid backwards into a fire hydrant at about 20mph. Took it to this one idiot to get it fixed. Charged me $850. Now I have orange peel textured paint on the rear left quarter, they didn't paint the entire panel, they stopped in like the middle above the rear left passenger window. So you can clearly see the blending line. The rear bumper was a Neptune rear bumper spray painted gray in attempt to match the gray plastic cladding on the rest of the car, and the clear is starting to peel along the third left rear window...don't know why I didn't catch all that before I took it off his lot now I'm stuck with it At least you caught yours though I wish you luck One reason why I don't let anyone touch my cars or bikes but in a situation like yours and mine you have to I don't have the equipment or skill to do body work and painting. I feel your pain.

Did they put the car on a frame jig to measure the key points of the vehicle to see if the fram maybe slightly out. Usually if there is a hit in the left side fender it will drive things slightly up or down. This usually transfers to the right side in the opposite fashion. When the boss had her second accident I had the car put on a jig and it measured the frame. No my insurance did not cover the cost but it was $100 of assurance for me that the frame was not tweeked in any way. If the frame was tweeked then the insurance would have kicked in.
